Terms of Service

Photography by Najah Service Terms and Conditions:

1. Introduction
These terms and conditions govern the contractual relationship between Photography by Najah ("Photographer") and the Client for photography services.

2. Services Provided
The Photographer agrees to provide professional photography services as specified. Details of the services, including the date, time, and location of the shoot, will be provided.

3. Booking and Payments
A non-refundable deposit is required to secure the booking.
The remaining balance is due 1 day before the scheduled shoot.
Payments can be made via Website, PayPal or CashApp.

4. Cancellation and Rescheduling
Cancellations within 7 days of the shoot will require full payment.
Rescheduling requests must be made at least 7 days before the shoot and are subject to the Photographer's availability.

5. Photo Delivery
Edited photos will be delivered within 10 days after the shoot.

Photos will be provided in digital format via online gallery.

6. Usage Rights
The Client receives personal usage rights for all delivered photos.
The Photographer retains copyright of all images and may use them for promotional purposes.

7. Model Release
The Client agrees that the Photographer may use images from the shoot for promotional purposes, including but not limited to social media, website portfolios, and marketing materials.

8. Liability
The Photographer will take the utmost care with respect to the capture, processing, and delivery of photographs. However, in the unlikely event of loss or damage, the Photographer's liability is limited to the return of all payments received.

The Photographer is not responsible for any injuries or damages sustained during the shoot.

9. Force Majeure
Neither party shall be liable for failure to perform any obligation under this agreement due to events beyond their control, such as natural disasters, strikes, or other unforeseeable circumstances.

10. Governing Law
These terms and conditions are governed by the laws of Florida, United States. Any disputes arising from these terms and conditions shall be resolved in the courts of Florida, United States.

11. Agreement
By booking the Photographer’s services, the Client agrees to these terms and conditions.
